ASSUMPTION OF RISK, WAIVER, AND RELEASE OF LIABILITY AGREEMENT AND COVID-19 RELEASE & HOLD HARMLESS AGREEMENT

In consideration of the acceptance of my registration and the benefits of my participation in The Old Volks Show sponsored by the VW Club of Oklahoma, I hereby release, waive, discharge and covenant not to sue the VW Club of Oklahoma and its affiliates, sponsors, divisions, assigns, successors in interest, agents, servants, employees, volunteers, officers, trustees and directors, past and present, and each of them (collectively the “Released Parties”), from any and all liability, claims, demands, actions and causes of action whatsoever, including attorney’s fees, arising out of or in any manner related to my participation in the The Old Volks Show, including any loss, damage, injury or death that may be sustained by me or my personal property, whether caused by the negligence of the Released Parties or otherwise. I understand that participation is completely my choice, and I choose to participate for my own personal benefit. I am fully aware of the risks involved with participation, and I expressly, voluntarily and willingly assume full responsibility for all risks and dangers associated with such participation, including, but not limited to, risk of bodily injury (including permanent disability or death) or property damage arising out of my participation, howsoever caused, and I accept personal responsibility for the damages arising from any such injury or property damage and hold the released parties harmless there from. I expressly waive any defense to enforcement of this agreement arising from any claim of lack of consideration and understand that this agreement constitutes a legal, valid and binding waiver of my rights and shall be enforceable against me, my spouse, family, heirs, assigns, personal representatives and estate for all purposes. I understand that my automobile(s) and I may be photographed or filmed during the event and agree to allow the VW Club of Oklahoma to use any photograph, video imagine or film likeness of me or my automobile(s)/motorcycle(s) for any legitimate purpose, including without limitation publication and program inclusion now and in the future, without financial compensation to me.

The current world-wide Coronavirus (“COVID-19”) pandemic and government-mandated “shelter in place” orders in many communities underscore the risks associated for individuals attending events with people from outside their household.
The undersigned understands that exposure to disease-causing organisms and objects, such as COVID-19, and personal contact with others, including but not limited to volunteers, car show staff members, car show judges, vendors, food truck vendors, car show spectators, car show entrants and others associated with the Old Volks Show and The VW Club of Oklahoma, involves a certain degree of risk that could result in illness, permanent disability or death. The undersigned also acknowledges that it is impossible to screen and/or monitor all such individuals.
After fully and carefully considering all the potential risks involved, I hereby assume the same and agree to release and hold-harmless the released parties and their employees, officers, agents, volunteers, sponsors, contractors and vendors from and against, all claims and liability resulting from exposure to disease-causing organisms and objects, such as COVID-19, associated with me either attending and/or participating in The Old Volks Show Volkswagen show.
I have carefully read this agreement, and my digital signature agreement acknowledges that I fully understand its content and meaning. I understand that I have given up substantial rights by signing this Agreement, and I sign it freely and voluntarily without any inducement. If I am signing this Agreement on behalf of a minor, I certify that all representations are true and that I have full authority to bind the minor and myself to the terms and conditions of this Agreement.
